Terms and Conditions of Sale and Use

These Terms and Conditions govern the use of www.shapeofsunday.com and the purchase of products sold under the name Shape of Sunday.
By placing an order through the website, the Customer confirms that they have reviewed these Terms and the other applicable policies available on the website.

Shape of Sunday is the trading name used for the sale of products offered on the website.
2. Scope
These Terms apply to purchases made through www.shapeofsunday.com.
The website is primarily intended for sales to consumers, meaning individuals purchasing for purposes unrelated to their business, commercial, craft or professional activity.
Any mandatory consumer rights granted by the law applicable in the Customer’s country remain unaffected where applicable.
3. Characteristics of second-hand products
Shape of Sunday primarily sells second-hand, vintage and pre-owned clothing and accessories.
By their nature, these products may show characteristics, signs of age or normal traces of previous use that differ from those of a new product.
Shape of Sunday aims to describe and represent each item as accurately as possible and to disclose any known defects, signs of wear or relevant characteristics at the time of sale.
Characteristics and signs of use expressly described on the product page or clearly shown in the photographs are considered known characteristics of the item at the time of purchase and should be assessed in light of the used nature of the product.
This does not limit the Customer’s rights in relation to any undisclosed lack of conformity.
4. Images, colors and measurements
Product photographs are intended to represent the items as faithfully as possible.
Colors may vary slightly depending on the screen, device, photographic lighting and display settings used.
For second-hand or vintage clothing, the size shown on the original label may not correspond to current sizing standards. For this reason, Shape of Sunday may provide garment measurements on the product page.
Measurements are taken manually and may be subject to small tolerances.
Customers are encouraged to review the description, photographs and measurements carefully before purchasing.
5. Product availability
Most items sold by Shape of Sunday are available as one-of-a-kind pieces.
Adding a product to the cart does not guarantee availability until the order has been completed.
In exceptional cases, a product may appear available even though it has already been sold, or it may no longer be physically available due to an inventory error.
In such cases, Shape of Sunday will promptly inform the Customer and refund in full any amount already paid for the unavailable product.
6. Prices
The applicable price is the price shown on the website at the time the order is placed.
Before completing the purchase, the Customer is shown the product price, any applicable taxes, shipping charges and any other costs payable through Shape of Sunday.
Any customs duties, import taxes or fees imposed by the destination country for international shipments are governed by the section on international shipping.
Shape of Sunday may change product prices at any time. Changes do not apply to orders already concluded.
7. Purchasing process
To make a purchase, the Customer selects the desired product, adds it to the cart and proceeds to checkout by providing the information required for payment and delivery.
Before submitting the order, the Customer can review the selected products, price, shipping charges and other relevant information.
By submitting the order, the Customer assumes the obligation to pay the stated price.
After the order is placed, a confirmation containing the main purchase information is sent to the email address provided by the Customer.
The Customer is responsible for the accuracy of the information provided during checkout.
8. Obvious errors
Shape of Sunday takes reasonable steps to ensure that prices and information on the website are accurate.
If there is an obvious error in the price, availability or description of a product, Shape of Sunday will contact the Customer as soon as possible.
If the order cannot be fulfilled because of the error, any amount already paid for the affected product will be refunded in full, in accordance with applicable law.
9. Payments
Available payment methods are shown during checkout.
Payments are processed through Shopify and/or third-party payment service providers.
Shape of Sunday does not directly receive full payment card details used by the Customer.
An order may be fulfilled only after payment has been properly authorised or confirmed by the relevant payment service provider.
10. Shipping
Orders are shipped from Italy.
Available destinations, shipping costs and delivery services are shown on the website or during checkout.
Orders are generally prepared within 1–3 business days after payment confirmation.
Delivery times shown on the website are estimates and may vary, especially due to customs inspections, public holidays, high shipping volumes, weather conditions, force majeure events or carrier delays.
Any consumer rights provided by applicable law in the event of delay or non-delivery remain unaffected.

11. Delivery address
The Customer must provide a complete and accurate delivery address.
If the Customer notices an error after placing the order, they should contact Shape of Sunday immediately at info@shapeofsunday.com.
Shape of Sunday will make reasonable efforts to amend the address before dispatch, but cannot guarantee that changes will be possible once the parcel has been handed over to the carrier.
Any additional costs resulting from an incorrect or incomplete address, unjustified refusal of delivery or failure to collect the parcel may be charged to the Customer to the extent permitted by law.
12. Transfer of risk
In consumer transactions, the risk of loss or damage remains with Shape of Sunday until the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the product, except where otherwise provided by applicable law.
If the Customer independently selects a carrier not offered by Shape of Sunday, any different rules provided by law will apply.
13. International shipping, customs and duties
Orders shipped outside the European Union may be subject to customs procedures, import taxes, duties or fees imposed by authorities or operators in the destination country.
Unless expressly stated otherwise at checkout, these amounts are not included in the product price or shipping charges and are the responsibility of the recipient.
Shape of Sunday does not determine these charges and cannot guarantee their amount in advance.
The Customer is responsible for any local customs formalities required to import the goods.
14. Right of withdrawal for EU consumers
A consumer purchasing online to whom European Union law applies has the right to withdraw from the contract, without giving any reason, within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the product.
If several products are purchased in one order and delivered separately, the period begins on the day the final product is delivered.
To exercise the right of withdrawal, the consumer must clearly communicate the decision to Shape of Sunday before the deadline expires.

15. Return following withdrawal
After communicating the withdrawal, the consumer must return the product without undue delay and in any event within 14 days from the date the decision to withdraw was communicated.
Unless otherwise stated or agreed, the direct cost of returning the product is borne by the consumer.
The Customer is responsible for properly preparing and shipping the return and is encouraged to use a tracked shipping method.
Products must be returned complete with any accessories or components received.
The consumer is responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
16. Refund following withdrawal
Where the right of withdrawal is validly exercised, Shape of Sunday will refund the payments received in relation to the returned products and, where required by applicable law, the cost of the least expensive standard delivery method offered for the order.
Any additional costs resulting from the Customer’s voluntary choice of a more expensive delivery method will not be refunded.
Unless otherwise agreed, refunds are made using the same payment method used for the purchase.
Shape of Sunday may withhold the refund until it has received the returned product or until the consumer supplies evidence of having sent it back, whichever occurs first.
17. Returns for customers outside the European Union
For Customers to whom the European statutory right of withdrawal does not apply, return options are governed by the Returns & Refunds Policy available on the website and by any mandatory rules applicable in the Customer’s country.
Any mandatory consumer rights under applicable law remain unaffected.
18. Legal guarantee of conformity
Products purchased by consumers are covered by the legal guarantee of conformity provided by applicable law.
The guarantee concerns lack of conformity existing at the time of delivery and does not cover defects resulting from subsequent use, normal wear and tear, misuse, inadequate maintenance or damage caused after delivery.
When assessing conformity of a second-hand product, its used nature, age, previous use and any characteristics or signs of wear expressly disclosed before purchase must be taken into account.
Characteristics, imperfections or signs of use specifically stated in the description or clearly communicated before purchase do not in themselves constitute a lack of conformity.
This does not affect the Customer’s rights in relation to undisclosed defects or products that do not match the description provided.
For used goods, applicable law may allow the seller and consumer to agree on a shorter liability period than for new goods, subject to any mandatory minimum period required by law.
19. Non-conforming or damaged products
If the Customer believes that the product received does not match the description, has an undisclosed defect or was damaged during transit, they should promptly contact:

The request will be assessed in accordance with the Customer’s rights under applicable law.
A request for photographs or other information needed for verification does not limit any rights granted to the Customer by law.
20. Intellectual property
Unless otherwise stated, content on www.shapeofsunday.com, including text, photographs, graphic elements, logos, names, layouts and other original materials, is owned by Shape of Sunday or used under legitimate rights or authorisations.
Such content may not be copied, reproduced, distributed, modified or used for commercial purposes without prior authorisation, except where permitted by law.
21. Use of the website
The website must be used in compliance with the law and with the rights of Shape of Sunday and third parties.
It is prohibited to use the website fraudulently, intentionally interfere with its operation, attempt unauthorised access to IT systems or use its content for unlawful activities.
Shape of Sunday may take reasonable measures to protect the website and its rights in the event of fraudulent, abusive or unlawful conduct.
22. Third-party services and links
The website may use or contain links to services operated by third parties, including payment services, social platforms, shipping services and other tools necessary for the operation of the store.
Use of third-party services may be subject to their own terms and policies.
Shape of Sunday does not control independent external websites or services and is not responsible for their content or activities, without prejudice to obligations imposed directly on Shape of Sunday by law.
23. Website availability
Shape of Sunday aims to keep the website accessible and operational but cannot guarantee uninterrupted availability.
The website may be temporarily unavailable due to maintenance, updates, technical issues, force majeure events or circumstances beyond Shape of Sunday’s reasonable control.
Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.
24. Personal data protection
The processing of users’ personal data is governed by the Privacy Policy and Cookie Policy available on the website.
These documents provide information about the collection, use and processing of personal data and the rights available to data subjects.
25. Changes to the Terms and Conditions
Shape of Sunday may amend these Terms to reflect changes in law, changes to the services offered or operational needs.
The new Terms apply to orders placed after publication, unless otherwise required by law.
Orders already concluded remain subject to the Terms applicable at the time of purchase.
26. Governing law
These Terms are governed by Italian law.
This choice does not deprive consumers of any mandatory protections granted by the law of the country of their habitual residence where such rules apply.
27. Disputes
If an issue arises in relation to an order, the Customer is encouraged to contact Shape of Sunday first at:
Shape of Sunday will, where possible, seek to resolve the dispute amicably.
The consumer’s right to use any competent alternative dispute resolution body or competent court under applicable law remains unaffected.
28. Severability
If any provision of these Terms is declared void, invalid or unenforceable, this will not affect the validity of the remaining provisions, which will continue to apply to the extent permitted by law.
